The terms that govern your use of Vitaaco: orders, subscriptions and auto-renewal, disclaimers, accessibility, and your SMS program.
Welcome to Vitaaco. These Terms of Service (“Terms”) are a legal agreement between you and Vitaaco LLC (“Vitaaco,” “we,” or “us”) covering your use of vitaacosuppliments.com and any purchase you make from us. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site. The terms for our SMS/text program are included as a section below.

Vitaaco contains caffeine and is intended for healthy adults 18 years of age or older. By ordering, you confirm that you are at least 18. The site and products are not directed to children, and you may not order on behalf of anyone under 18.
All orders are subject to acceptance and availability, and we may decline or cancel an order, for example, if a product is mispriced or unavailable. Prices, promotions, and product details may change at any time before you order. We work to describe products accurately but do not warrant that all content is error-free. Any promotional or locked-in price applies only as described at the time of purchase and may be subject to reasonable conditions, including that a related subscription stays active and uninterrupted. You authorize us to charge your payment method for the total shown at checkout, including any taxes and shipping.
If you choose a subscription (for example, “Subscribe & Save”), you are enrolling in an automatically renewing plan. You authorize Vitaaco to charge your payment method the subscription price shown at checkout on a recurring basis, at the interval you select, until you cancel. Your card is charged when each order is prepared for shipment, and your price stays as described for your plan unless we notify you of a change in advance.
Introductory pricing and the welcome kit. Some Subscribe & Save plans include an introductory price on your first shipment that then changes to the standard recurring price on later shipments (for example, $35 on your first order and then $40 every 30 days, plus applicable shipping and tax). The exact amounts, billing interval, and any first-order shipping charge are shown clearly at checkout before you confirm, and by placing the order you consent to those recurring charges. A one-time welcome kit (such as a branded glass and reusable straw) is included with the first subscription shipment only, is limited to one per customer, and is not included in renewal shipments. Any promotional code (for example, a free-shipping code) applies only as described at the time you use it.
Cancel anytime. You can pause, change, or cancel future subscription orders at any time before your next order is processed, through your account page or by emailing Vitaaco@vitaaco.com. Cancellation stops future charges; it does not refund an order that has already shipped, except as covered by our returns policy. Where your state’s law requires it, we will provide renewal or cancellation reminders and honor the cancellation methods that law requires.
Shipping timelines and costs are described on our Shipping page, and returns and refunds are handled under our Returns policy. Risk of loss passes to you when the carrier receives your order. Please review those pages, they are part of these Terms.
Vitaaco is a dietary supplement, not a drug, and is intended to support general focus and everyday wellness in healthy adults. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Vitaaco contains 200 mg of caffeine per serving and is not recommended for anyone sensitive to caffeine, pregnant or nursing, under 18, or managing a medical condition or taking medication without first consulting a physician. Any results, testimonials, reviews, or quiz outputs shown on the site reflect individual experience and are provided for general information only. Individual results may vary, and nothing on the site is medical advice or a substitute for care from a qualified professional.
To the fullest extent permitted by law, the site and products are provided on an “as is” and “as available” basis, and Vitaaco disclaims all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
To the fullest extent permitted by law, Vitaaco and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the site or products. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.
You agree to use the site lawfully and not to misuse it, interfere with its operation, or submit false, infringing, or abusive content (including reviews). All site content, branding, and the Vitaaco name and logo are owned by Vitaaco or its licensors and may not be used without permission. If you submit a review or other content, you grant us a non-exclusive, royalty-free license to display and use it in connection with our business.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at Vitaaco@vitaaco.com so we can try to resolve it informally. Any dispute that cannot be resolved will be handled in the state or federal courts located in Fresno County, California, and you consent to that venue, except where applicable law gives you the right to bring a claim elsewhere.
Vitaaco is committed to making our website usable for everyone, including people with disabilities, and we are working to align with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Accessibility is an ongoing effort. If you have trouble using any part of the site, or need this information in another format, email Vitaaco@vitaaco.com and we will work with you to provide the information, product, or service you need through a communication method that works for you.
We may update these Terms from time to time. When we do, we will change the “last updated” date above, and significant changes take effect when posted. Your continued use of the site or a subscription after an update means you accept the updated Terms.
The following terms apply specifically to Vitaaco’s SMS/text message program, in addition to the terms above.
The Vitaaco mobile message service (the “Service”) is operated by Vitaaco (“Vitaaco”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Vitaaco’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Vitaaco through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Vitaaco. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt out of the Service at any time. Text the single keyword command STOP to +1 (833) 853-2451 or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Vitaaco mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
